These Terms of Use and Service Disclaimer (“Terms”) govern your access to and use of NewPhaseHomePro.com and any services provided through New Phase Home Pro (“New Phase Home Pro,” “we,” “our,” or “us”).

By accessing our website, requesting a contractor, submitting information, requesting an estimate, scheduling an appointment, or otherwise using our services, you acknowledge that you have read, understood, and agree to these Terms.

If you do not agree with these Terms, you should not use the website or our services.

1. NATURE OF NEW PHASE HOME PRO’S SERVICES

New Phase Home Pro provides a home-improvement referral, matching, coordination, and concierge service designed to help homeowners locate contractors and other service professionals for residential repair, maintenance, remodeling, installation, and improvement projects.

Depending upon the particular project and arrangement, New Phase Home Pro may assist customers with:

  • Identifying potential contractors or service professionals;
  • Gathering information concerning a proposed project;
  • Coordinating appointments;
  • Facilitating communications between customers and service professionals;
  • Obtaining or communicating estimates;
  • Assisting with project coordination; and
  • Providing other administrative or concierge services.

Unless expressly stated otherwise in a separate written agreement, New Phase Home Pro is not the contractor performing the construction, electrical, plumbing, HVAC, roofing, or other regulated trade work.

The contractor or service professional hired for a project is responsible for performing the work and for complying with applicable laws, codes, licensing requirements, permitting requirements, inspection requirements, and professional standards applicable to that work.

2. INDEPENDENT SERVICE PROFESSIONALS

Contractors and other service professionals introduced, referred, matched, or otherwise made available through New Phase Home Pro may be independent businesses and are not necessarily employees, agents, partners, joint venturers, or representatives of New Phase Home Pro.

Unless expressly provided in a separate written agreement, New Phase Home Pro does not control the manner or method by which an independent contractor performs its work.

The contractor performing the work is responsible for its employees, subcontractors, workmanship, tools, materials, job-site practices, safety procedures, permits, licenses, insurance, taxes, warranties, and compliance with applicable laws.

3. CONTRACTOR LICENSING

Certain home-improvement and construction services require state, county, or municipal licenses, registrations, permits, or certifications.

Contractors and service professionals participating in the New Phase Home Pro network may be required to provide information concerning their qualifications and, when applicable, their licensing and insurance.

However, licenses, registrations, insurance policies, corporate status, disciplinary history, and other information can expire, change, be suspended, or otherwise become inaccurate.

Therefore, customers are encouraged to independently verify the current license and insurance status of any contractor before entering into an agreement or allowing regulated work to begin.

New Phase Home Pro does not guarantee that information received from a contractor, governmental database, third-party service, or other source will always be complete, accurate, or current.

4. NO GUARANTEE OR ENDORSEMENT

A referral, introduction, recommendation, listing, or match made through New Phase Home Pro does not constitute a guarantee of any contractor’s workmanship, performance, pricing, availability, qualifications, financial condition, or ability to complete a particular project.

Customers remain responsible for evaluating a contractor before hiring that contractor.

New Phase Home Pro encourages homeowners to review estimates carefully, ask questions, verify licenses where applicable, confirm insurance coverage when appropriate, and obtain a written agreement describing the work to be performed.

5. ESTIMATES AND PROJECT PRICING

Any preliminary price, project range, cost estimate, or other pricing information appearing on NewPhaseHomePro.com or communicated before a contractor evaluates the project is provided for informational purposes unless expressly identified as a binding written proposal.

Actual project pricing may vary because of job-site conditions, material selections, permit requirements, code requirements, concealed conditions, engineering requirements, customer-requested changes, labor requirements, material costs, or other circumstances.

The contractor’s final written agreement or proposal should identify the scope of work and price applicable to the project.

6. CONTRACTS WITH SERVICE PROFESSIONALS

Unless a written agreement expressly states otherwise, a contract for construction, repair, installation, remodeling, or other trade services is between the homeowner and the contractor or service professional performing those services.

New Phase Home Pro is not automatically a party to a contract merely because it introduced the parties, transmitted information, scheduled an appointment, assisted with communication, or helped coordinate the project.

The terms of the customer’s contract with the contractor govern the contractor’s obligations concerning workmanship, completion dates, warranties, materials, payments, changes to the scope of work, and other project-specific matters.

7. PAYMENTS

Depending upon the service offered, New Phase Home Pro may facilitate or process certain payments associated with a project.

Processing or facilitating payment does not, by itself, make New Phase Home Pro the contractor performing the underlying construction or home-improvement services.

Any applicable payment terms, deposits, refunds, cancellation provisions, contractor payments, service fees, or administrative fees may be described separately when the customer requests or purchases a particular service.

8. PERMITS AND CODE COMPLIANCE

When permits, inspections, licensed contractors, engineering, or other governmental approvals are legally required, responsibility for obtaining and complying with those requirements will be determined by the applicable contract and applicable law.

Customers should not assume that a permit is unnecessary merely because one has not been discussed.

The contractor performing regulated work remains responsible for performing that work in accordance with applicable licensing requirements, building codes, electrical codes, plumbing codes, mechanical codes, and other applicable laws and regulations.

9. CUSTOMER RESPONSIBILITIES

Customers agree to provide accurate information regarding their property and proposed project.

Customers are responsible for notifying the contractor of known conditions that could affect the work, including known electrical, plumbing, structural, environmental, access, property-boundary, association, or building restrictions.

Customers should review all contracts, estimates, change orders, warranties, permit requirements, and payment schedules before authorizing work.

10. THIRD-PARTY INFORMATION

The website may contain information supplied by contractors, homeowners, manufacturers, governmental databases, third-party websites, or other sources.

New Phase Home Pro cannot guarantee that all third-party information is complete, current, or error-free.

Links to third-party websites are provided for convenience and do not necessarily constitute an endorsement of those websites, companies, products, or services.

Third-party websites operate under their own terms and privacy policies.

11. REVIEWS, PHOTOGRAPHS AND CUSTOMER CONTENT

Customers may have the opportunity to submit reviews, photographs, comments, project descriptions, testimonials, or other content.

By voluntarily submitting such content to New Phase Home Pro, you represent that you have the right to provide it and that its use will not violate another person’s intellectual-property, privacy, publicity, or other legal rights.

You authorize New Phase Home Pro to use submitted project photographs, reviews, testimonials, and similar content for legitimate business and promotional purposes, subject to applicable law and our Privacy Policy.

New Phase Home Pro reserves the right to decline, remove, or moderate content that is fraudulent, unlawful, abusive, misleading, defamatory, irrelevant, or otherwise inappropriate.

12. PROJECT DISPUTES

If a dispute arises concerning workmanship, project delays, materials, property damage, warranties, additional charges, or another issue directly related to work performed by an independent contractor, the homeowner should first attempt to resolve the issue directly with that contractor.

New Phase Home Pro may, at its discretion, assist the parties with communication or resolution of a dispute.

Any such assistance is voluntary and does not make New Phase Home Pro responsible for the underlying work or create an obligation to compensate either party.

Nothing in these Terms eliminates any rights or remedies that cannot legally be waived under applicable law.

13. NO WARRANTY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEWPHASEHOMEPRO.COM AND THE SERVICES AND INFORMATION AVAILABLE THROUGH THE WEBSITE ARE PROVIDED ON AN “AS AVAILABLE” AND “AS IS” BASIS.

NEW PHASE HOME PRO DOES NOT MAKE WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE CONTINUOUS AVAILABILITY OF THE WEBSITE, THE ACCURACY OF THIRD-PARTY INFORMATION, OR THE PERFORMANCE OF INDEPENDENT CONTRACTORS.

NOTHING IN THIS SECTION EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEW PHASE HOME PRO SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE CONDUCT, WORK, OMISSIONS, REPRESENTATIONS, OR SERVICES OF AN INDEPENDENT CONTRACTOR OR OTHER THIRD PARTY.

NEW PHASE HOME PRO SHALL NOT BE RESPONSIBLE FOR A CONTRACTOR’S WORKMANSHIP, DELAYS, FAILURE TO COMPLETE A PROJECT, PROPERTY DAMAGE, PERSONAL INJURY, CODE VIOLATIONS, PERMIT VIOLATIONS, WARRANTY CLAIMS, OR OTHER ACTS OR OMISSIONS EXCEPT TO THE EXTENT LIABILITY IS IMPOSED UPON NEW PHASE HOME PRO BY APPLICABLE LAW AND CANNOT LEGALLY BE DISCLAIMED.

Nothing contained in these Terms is intended to waive or limit liability where such limitation or waiver is prohibited by law.

15. INDEMNIFICATION

To the extent permitted by applicable law, users agree to indemnify and hold New Phase Home Pro and its owners, officers, employees, representatives, and affiliates harmless from third-party claims arising from the user’s unlawful misuse of the website, intentional misconduct, violation of these Terms, or infringement of another person’s rights.

This provision does not require a consumer to indemnify New Phase Home Pro for liability that applicable law does not permit New Phase Home Pro to transfer or disclaim.

16. WEBSITE INFORMATION

Information provided on NewPhaseHomePro.com concerning home repairs, construction methods, estimated pricing, electrical systems, plumbing, HVAC, remodeling, permits, building codes, or similar subjects is provided for general informational purposes.

It should not be considered engineering, architectural, legal, financial, or other professional advice.

Project conditions differ substantially from property to property. Appropriate professionals should evaluate a property before a homeowner relies upon general website information for a specific project.

17. INTELLECTUAL PROPERTY

The New Phase Home Pro name, logo, website design, original photographs, graphics, text, and other original website content are owned by or licensed to New Phase Home Pro unless otherwise indicated.

Users may not reproduce, republish, sell, scrape, systematically download, distribute, or commercially exploit New Phase Home Pro website content without prior authorization.

18. PROHIBITED USE

Users may not use NewPhaseHomePro.com to:

  • Commit fraud or another unlawful act;
  • Provide knowingly false information;
  • Impersonate another person or business;
  • Interfere with the operation or security of the website;
  • Introduce malicious software;
  • Scrape or systematically harvest website information without authorization;
  • Harass homeowners, contractors, employees, or other users; or
  • Violate another person’s intellectual-property, privacy, or contractual rights.

New Phase Home Pro may restrict or terminate access to its services when it reasonably believes the services are being misused.

19. PRIVACY AND COMMUNICATIONS

Information submitted through NewPhaseHomePro.com may be used to respond to service requests, coordinate projects, communicate with customers, and connect customers with appropriate contractors or service professionals.

When a customer requests assistance locating a contractor, the customer authorizes New Phase Home Pro to provide information reasonably necessary to respond to the request to prospective service professionals.

Additional information concerning the collection, use, storage, and disclosure of personal information should be described in the New Phase Home Pro Privacy Policy.

20. TELEPHONE, TEXT AND EMAIL COMMUNICATIONS

When you voluntarily provide a telephone number or email address in connection with a service request, you authorize New Phase Home Pro and, where appropriate, service professionals responding to your request to contact you concerning that request, subject to applicable law and any consent language presented when your information is submitted.

Marketing communications will be handled in accordance with applicable law and any consent provided by the user.

21. MODIFICATIONS

New Phase Home Pro may modify these Terms periodically.

The updated version will be posted on NewPhaseHomePro.com with a revised “Last Updated” date.

Continued use of the website after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

22. GOVERNING LAW

These Terms shall be governed by applicable federal law and the laws of the State of Florida, without regard to conflict-of-law principles, except where another jurisdiction’s law is required to apply.

23. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary while the remaining provisions remain in effect.

24. ENTIRE AGREEMENT

These Terms, together with the New Phase Home Pro Privacy Policy and any additional written terms applicable to a particular service, constitute the agreement governing use of NewPhaseHomePro.com.

A separate written agreement between a homeowner and contractor may contain additional terms governing a particular project.

25. IMPORTANT HOMEOWNER NOTICE

NEW PHASE HOME PRO IS A HOME-SERVICES REFERRAL, MATCHING, COORDINATION AND CONCIERGE PLATFORM. UNLESS EXPRESSLY IDENTIFIED OTHERWISE IN A WRITTEN CONTRACT, NEW PHASE HOME PRO DOES NOT ITSELF PERFORM THE LICENSED CONSTRUCTION OR TRADE SERVICES REQUESTED BY A HOMEOWNER.

HOMEOWNERS SHOULD VERIFY THE CURRENT LICENSE, INSURANCE AND QUALIFICATIONS OF THE CONTRACTOR ACTUALLY PERFORMING THE WORK BEFORE ENTERING INTO A CONTRACT.

THE CONTRACTOR PERFORMING THE WORK IS RESPONSIBLE FOR THE QUALITY, SAFETY, LEGALITY AND CODE COMPLIANCE OF ITS WORK, SUBJECT TO THE CONTRACT BETWEEN THE HOMEOWNER AND CONTRACTOR AND APPLICABLE LAW.
